Terms and Conditions
The terms and conditions that are laid out below are in place to ensure the photography work taken out by Monika Baster Photography is completely transparent and no misunderstandings take place in any way with regards to the products or services offered.
The acceptance
All bookings are accepted with an understanding that the terms and conditions below are agreed with in it’s entirety. Where the terms state ‘photographer’ they are referring to Monika Baster Photography.
Booking
The session fee and any product either in physical for or digital form are stated in the pricing guide and includes my time taking and preparing your images from your session. All portrait sessions must be paid for in full on or before the day of your photography session. A deposit must be paid prior to your session date to secure your booking. You will be advised on the required value of the deposit. If necessary you can reschedule your session up to 48 hours prior to your booking date. After this time you will be liable to a £40.00 rebooking fee.
Deposits and full payments can be made by bank transfer or cash
All prices are subject to change at the discretion of Monika Baster Photography
Sickness
Due to the nature of my job I keep myself in good health and I am rarely ill. That said, I will not put a newborn, young baby or toddler in a situation where they could be infected with an illness. Should I become unwell. I will have no other option other than to postpone the session. Refunds will not be given. We will work together to rescheduled a time and date for your session.
If the client or child should fall ill prior to the session, the client agrees to make every possible effort to inform the photographer as soon as possible prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 2 week period. The photographer reserves the right to re-schedule outside of this time limit due to any existing commitments. If the client fails to reschedule within the 2 week time period, the photographer has the right to cancel the booking with all payments made non-refundable. In the event of the client or child falling ill during the session. The photographer reserves the right to postpone the photo shoot and re-schedule at the convenience of both parties.
Cancellations
Should for any reason you wish to cancel your booking and not wish to reschedule you will NOT be entitled to a refund of any deposit paid, unless at the discretion of Monika Baster Photography under exceptional circumstances.
Liability
Monika Baster Photography owns and secures high quality cameras, equipment, memory cards, and computers to photograph and process your images. However, malfunctions can occur through circumstances beyond control. Monika Baster Photography will not/cannot be held accountable or liable for any images lost or damaged including but not limited to equipment malfunction, natural disasters, technical errors, or computer malfunctions etc. every effort will be made to reschedule a new session.
Images
Following the photographic session you will be provided with an access code to an online client proofing gallery. This will be made available for One week. During this time you should make your selections. After One weeks the gallery is removed and there is a £20 fee to republish your gallery. If this is a concern or there are technical issues, please contact me immediately so we can work on successfully getting your images to you.
Once your image selections have been made your images may take 2-3 weeks to be fully edited and delivered from the date of your returned selections via an online client proofing gallery. However, during peak photography periods, this can be longer. Should you need the images sooner, please do not hesitate to contact me and I will see what I can do.
Additional prints and products are available to purchase after your photography session and prices are in addition to the package fee agreed. All portraits are prepared for print to a very high standard. Specific additional retouching of images is provided on request. This may be subject to an additional fee. Additional prints are available to purchase with any package. Due to the nature of individual print sizes, crops may vary slightly from the on-line gallery preview. All prints and products are supplied to order and non-refundable once your order has been placed. All art work for photo albums and prints will be produced to a very high standard. Care and attention is taken to prepare each image and once you have received your final product no changes can be made. Text for announcement cards and the front of portrait albums will be confirmed by email and/or on your confirmation invoice. It is the clients responsibility to ensure that all text is correct as changes cannot be made once the order has been placed.
Digital Package
The high resolution digital images are available to buy as quoted in the package price guide. The price reflects the buy out of your images and the time taken to prepare each image for print. Image copyright remains with Monika Baster Photography.
The client is not entitled to any images edited or otherwise that may have been taken which are not included in the package price guide.
The low resolution digital images supplied with the session package are 72DPI @ 400px by 800px images will have the photographer logo on the image and you are not permitted to crop or alter the image in any way. Digital files are not sold separately but additional images can be added to the digital package at the per image price outlined in the product Guide.
The term High Resolution Digital images refers to images that will be supplied at 300DPI Only the number of images stated in the chosen photography package are supplied. You will not be given the non edited images from your photography session.
Copyright
It is understood that the copyright of all and any photographs belongs indefinitely to Monika Baster Photography under a Right Managed Licence.
The removal of the Photographer copyright notice or logo by any person or machine other than by the photographer or his appointed agent is prohibited.
If you have purchased the ‘high resolution images’ you and only you are free to use the images for personal use only in the form of prints and photo books, or on any other media for an unlimited time period.
Commercial use of the images in any manner is prohibited.
For purposes of this agreement, electronic rights are defined as rights in the digitised form of works that can be encoded, stored, and retrieved from such media as computer disks, hard disks, flash media, removable storage media, computer databases, and network servers.
As stated above, ownership of the images will indefinitely be the property of Monika Baster Photography. You must not edit these photos or apply any filters or presets from ANY program or social media to the images, it would be considered a breech of this contract.
Image storage
Once you have received your images Monika Baster Photography will no longer be responsible for storing your image files.
Gift Certificates, Special Offers etc
Special offers are available from time to time and are limited to the terms & conditions of that offer. Gift certificates are for the amount stated and can only be redeemed once. The extension of any offer beyond the expiry date is solely at the discretion of the Monika Baster Photography and any price guides supplied at the time of the offer may be subject to change after this date.
